This application is filed by the applicant namely Annu
Radheshyam Yadav for release of Redmi Note 8 Pro mobile phone, which
is seized by the Kherwadi in connection with Crime No. 385/2021
registered with said police station for the offences punishable under section
379 of IPC.
2) Say was called from I. O. and A.P.P. I.O. has no objection. The
Ld. APP has an objection and submitted that said muudemal is essential at
the time of trial. He prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record xerox copy of invoice, FIR & statement alongwith his
affidavit. The applicant failed to file verified or original copy of tax invoice
of said mobile. Therefore, he is not entitled to get the custody of the said
muddemal. Under such circumstances, I pass following order :
