This is case registered in view of charge sheet filed
against accused Ajay Ashok Chandaliya in crime no. 758 of 2021 of
Vakola Police station for the offence punishable under sec/ 326,
506(2) r/w 34 of IPC. It reveals that previously police had filed
Chargesheet against accused no 1 Amar Ashok Chandaliya in same
crime. Accordingly said case was registered as CC No.
2392/PW/2021. Later on the police submitted supplementary charge
sheet against accused no 2 Ajay Chandaliya said charge sheet
required to be attached with CC No. 2392/PW/2021 but
inadvertently the court staff registered it as a separate case vide CC
No. 622/PW/2022. Both cases are arising out of same incident and
filed by the police on same FIR. Therefore I hold that both the cases
required to be club together and both accused shall be tried together
in single case. Accordingly the CC No. 622/PW/2022 must be merged
with CC No. 2392/PW/2021. Hence, I proceed to pass following
order.
Order
1. The CC No. 622/PW/2022 must be merged with C. C. No.
2392/PW/2021.
2. The CC No. 622/PW/2022 be disposed off from CIS of Court
system.
3. Both accused are directed to be face trial in CC
No.2392/PW/2021.
