ORDER BELOW EXH.1
1. Complainant and advocate present. Accused and his
advocate absent.
2. Heard advocate for complainant. Written notes of
arguments on behalf of the complainant are accepted.
3. Perusal of proceeding shows that depsite of giving more
than sufficient opportunity, the accused has not exercised his right to
lead evidence in rebuttal. Perhaps accused may not have the probable
defence to contest the case and as such even the statement of accused
to be recorded under section 313 of Code of Criminal Procedure was
dispensed with. The accused seems to be reluctant. Therefore,
considering the year of the case and mandate of law to conclude the
hearing of the case within six months, I pass following order.
ORDER
1.The right of accused to advance arguments stands closed.
2.The matter be posted for Judgment on next date.
