Cross examination of CW-01- Dipak Kumar Goyel by advocate Mr. Ankush
Vishwakarma for the accused:
14. I am running business of Adhesive tapes. I have document
with me to show that I am proprietor of S.K. Industries. I will produced it
on next date. I am running business from 2008. I have read notice,
complaint and contents of evidence affidavit. Accused had not given
purchase order in writing to me. I raised the invoices mentioned in para 3
of evidence affidavit through transport who delivered the material. It is
true to say that I have not stated in my complaint that I delivered the
invoices to the accused through transport. It is not true to say that I am
deposing false that I sent the invoices through transport to the accused.
Our accountant Shri Kandan Pillai prepares and maintains the account. It
is true to say that none of the invoice produced by me at Ex.17 to 22
bears signature of the receiver or stamp of accused. It is true to say that
there is no signature of receiver of goods or accused on Lorry Receipts
produced by me at Exh.25 to 29. It is true to say that the name of the
transporter is not printed or mentioned on any of the tax invoices at
Exh.17 to 22.
15. I can not tell on what date accused has given cheque Exh.30.
Accused has not given the cheque visiting personally to me. The cheque
was sent by currier. I have not preserved the currier details with me. It is
not true to say that accused has not issued cheque Exh.30 in discharge of

any liability. I had personally given the instructions to draft notice to my
advocate. It is not true to say that the demand notice was not received by
the accused. It is not true to say that I have filed false case against the
accused. It is not true to say that accused is not liable to pay the amount
mentioned in the cheque. It is true to say that Ledger Account Extract
Exh.23 does not bear seal of my company.
