ORDER BELOW EXH.01
The complainant and his advocate absent since last so many
dates. Matter is pending since year 2020 for taking cognizance.
2. Complainant has not filed affidavit of verification statement to be
recorded under section 200 of Code of Criminal Procedure nor taken any
steps to comply the same since filing complaint in the year 2020. Evidence
affidavit and Original documents are not filed.
3. There are no sufficient grounds for proceeding against the
accused with the complaint on available material on record. Keeping the file
pending years together without proceeding further by the complainant is
unjustified. Hence, I pass following order.
ORDER
1. Complaint is dismissed under section 203 of Code of Criminal
Procedure and section 226 of Bharatiya Nagarik Suraksha Sanhita,
2023.
2. Proceeding stands closed.
3. Order dictated and pronounced in open court.
