ORDER BELOW EXH.1.
Perused the application with filed documents. Heard the
Ld. Advocate for applicant. The applicant is praying to direct Kherwadi
police station to call report under section 173 of Cr.P.C. in FIR
No.32/2014. After perusal of the FIR, it reflects that FIR is registered by
Kherwadi PSO and now the applicant praying under section 156(3) of
the Code of Criminal Procedure for proper investigation. The provisions
of said section are not applicable in the present application. The scope
of this section is different. Already investigation is going on and no
Magistrate can direct I.O. to file report. It is the investigation part and
I.O. have full liberty to investigate and thereafter file final report.
Hence, the prayer of applicant is rejected. It be closed.
