1. The case is pending since 2017. The case is fixed for appearance of
accused. The prosecution failed to secure the presence of the accused. Thus, the
case is placed in Special Drive in view of Letter of Hon'ble High Court bearing No.
B(Gen)1001/2022/157 dtd. 31.01.2022 with endorsement of office of Hon'ble
CMM bearing Inward No. 501/2022.
2. The case is summarily triable if the nature of offences is considered.
C. A. report is not filed on record. Ample opportunity has been given to the
prosecution. No fruitful purpose will be served by keeping the matter pending on
board. Hence, there is sufficient ground to stop the proceeding.
3. Therefore, proceeding is stopped u/s. 258 CrPC. Accordingly,
following order is passed.
O R D E R
i] The proceeding is stopped u/s 258 of Cr.P.C. The accused
stand released from the offence punishable u/s 65(e) of
Maharashtra Prohibition Act.
ii] The bail bond of the accused stand cancelled.
iii] Seized liquor be sent to the Collector of Excise for disposal as
per law. Seized cash be credited to the State.
iv] BW/NBW issued, if any, be returned without execution.
v] Case papers be filed.
