The complainant and advocate absent. The case is pending since
year 2021. No further steps by the complainant till date. Heard advocate
Rutuja Thaker for accused. She submitted that already matter is settled.
Accused No.1 company reported to be under liquidation. Complainant has not
filed say to application Exh.13 filed on behalf of accused No.2 and 4 for stay
of trial under section 96 r/w. section 101 of I.B.Code 2016. Complainant
absent despite keeping matter in the caption of dismissal. It seems that due to
settlement between parties complainant might have lost interest in
proceeding with the matter and as such not taking steps. Keeping file pending
years together without proceeding further taking appropriate steps by the
complainant is unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case. Hence, I
pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide section
256 of Code of Criminal Procedure and section 279 of Bharatiya
Nagarik Suraksha Sanhita, 2023.
2. Accused are acquitted of the offence punishable under section 138
of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
