ORDER BELOW EXH.1 Read complaint, affidavit of complainant. Perused the documents placed on record. Heard Ld. Advocate Shri N. K. Sharma for complainant. The complainant has filed complaint under section 409, 420, 120 (B) of the Indian Penal Code and prayed for investigation by police, as per the provision of section 156 (3) of the Code of Criminal Procedure. 2. It is alleged that, the accused Manoj Bhambania taken diamonds worth I95,00,000/- from complainant and issued acknowledgment receipt but did not paid amount to the complainant. Despite of complaint to police, police have not taken any cognizance. In another crime registered against Manoj Bahmbania police have recorded statement of complainant regarding the fact that, the accused has not repay the consideration amount for diamonds. The complainant discloses commission of cognizable offence by accused. 3. I am of opinion that, detail investigation by police is necessary, therefore, the matter be sent to B.K.C. police station for investigation under section 156 (3) of the Code of Criminal Procedure.
