ORDER BELOW BAIL APPLICATION, EXH.5
1. Perused record. Heard both the sides.
2. The accused prayed for bail mainly on the ground that he is poor
and innocent. Investigation is over and he is ready to remain abide by the
conditions, if any, imposed, etc. Investigating Officer and Ld. A.P.P.
objected to it stating that investigation is in progress and there is
possibility of tampering.
3. Accused is in custody since long. Investigation relating to accused
is over and charge sheet is now filed. The charge sheet reflects nothing
much about the accused. He seems to be arrested only on the ground of
suspicion. Offence is triable by this Court itself. Accused is ready to
remain abide by the conditions. The accused not produced since long by
jail authorities. It appears that framing of charge and consequent
conclusion of trial will take much time. Considering all these aspects and
facts and circumstances and reasons assigned in the bail application
following order.
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.15,000/-. Permission granted to deposit cash security in substitution of
surety bond.
c. Accused person shall furnish his detail address and proof thereof.
