ORDER BELOW EXH.1
The applicant has filed application for to issue 'No
Objection Certificate' for refund of court fees. It is contended that the
applicant has paid court fee of Rs.1,08,000/ in online portal for filing
complaint u/sec.138 of N.I.Act, vide challan No.MH010410716202223E
dated 10.11.2022. The dispute between the complainant and the
accused has been settled before filing of the complaint. Hence, the
complainant has not utilized said challan in any case. He has applied for
refund of Court fees at Collector of Stamps, Andheri, but, the collector
refused to refund court fees and requested him to bring 'No Objection
Certificate' from the court. I have gone through the record. The said
challan is not defaced till today. The applicant is entitled to refund the
court fees. Hence, I proceed to pass following order.
ORDER
1. The application is allowed.
2. Issue 'No Objection Certificate' to the applicant for
refund Court fees of challan No. MH010410716202223E.
