ORDER
1. The applicant is praying for return of gold Mangalsutra
weighing 30 grams, Ear Rings studded with diamonds weighing 10 grams
and gold Ear Rings weighing 5 grams seized by Vakola Police Station in C.
R. No.136/2022 registered u/sec. 380 of IPC.
2. The Investigating Officer has no objection to return the
ornaments to the applicant.
3. The applicant submitted that theft took place at her house and
abovementioned gold ornaments were stolen. She lodged report about
incident. She is praying for return of above mentioned ornaments seized
by the police. She has produced copies of FIR, seizure panchnama and
Aadhar Card in support of her version. No one else has claimed the
custody of the seized ornaments. Further, it will not be proper to keep the
seized ornaments at the police station for longer period. Thus, there is no
hurdle to handover the seized ornaments to the applicant by imposing
conditions. In the result, following order is passed :
ORDER
1. The custody of gold Mangalsutra weighing 30 grams, Ear
Rings studded with diamonds weighing 10 grams and gold Ear
Rings weighing 5 grams seized by Vakola Police Station in C.
R. No.136/2022 registered u/sec. 380 of IPC be returned to
the applicant.

2. The applicant is directed to furnish indemnity bond of
Rs.2,45,000/.
3. Applicant is directed not to transfer, alter, dispose or hand
over the said seized property to third person without prior
permission of Court and to produce it before the Court,
whenever required for trial.
4. The Investigating Officer is directed to take the clear
photographs of the property before handing over its custody to
the applicant, at the cost of the applicant and produce the
photographs and indemnity bond alongwith the final report.
