ORDER BELOW EXHIBIT - 01
1. Today the matter is taken before this Court in Special Drive. Perused
record. The present report is filed against the accused in respect of an
offence punishable under Section 285 of Indian Penal Code. The maximum
punishment provided for this offence is fine and imprisonment upto six
months in the offence.
2. The alleged incidence occurred on 05.12.2019 and final report is filed
on 12.03.2021. As per Section 468(2)(b) of Code of Criminal Procedure,
the maximum time provided to take cognizance for the offence with which
the accused is charge sheeted is one year.
3. As stated above the alleged incidence occurred on 05.12.2019 and
final report is filed on 12.03.2021, thus cognizance is barred by limitation
and hence, following order :
