ORDER BELOW EXH.01
1. During jail court on 04.10.2021, the accused Kishor Nandesh
Pawar @ Bunty, appeared. He submitted that he is innocent and despite
in jail for substantial period no bail is granted to him. He requested this
court to release him on bail. Therefore, today this case is taken on board.
2. Perused record. The investigation relating to accused is over since
long back and charge sheet is filed on 31.03.2020. He is in custody since
his arrest on 22.11.2019. Till today neither charge frame nor any further
proceeding occurred almost after completion of two years of his
detention. The oral prayer for bail by the accused considered. The record
shows that the offence is triable by this Court itself. Accused is ready to
remain abide by the conditions, if any. The stake of property involved is
not much high. Other accused already pleaded guilty and undergone
sentence. Considering all these aspects and reasons mentioned above I
am of the opinion that this is a fit case to grant bail. Merely because
accused is in jail and unable to make written representation for bail, his
liberty can not be curtailed further. Accused is not in a position to
furnish surety bond. Therefore, following order -
ORDER
The accused Kishor Nandesh Pawar, be released on bail on his
furnishing P.B. of Rs.3,000/-. Accused shall furnish his detailed address
and its proof withing one month after his release from jail.
