Order Below Bail Application
Perused bail application and say. Heard both side. Accused Mr.
Bibhishan Kisan Jedhe is charged for the offence punishable
U/Secs.318(4), 319(2), 336(2), 336(3), 338, 340(2), 3(5) of the BNS
and Sections 66-C and 66-D of Information Technology Act. Prosecution
alleged that, accused has cheated the informant and misappropriated
Rs.3,39,93,966/-. Out of which Rs.42,50,000/- are transferred to his
account. Said amount is required to be recovered. It is cyber fraud. The
panchanama shows that the active role of the present accused in the
cyber fraud. Investigation is not over. It is in progress. Offence is non-
bailable. Therefore, considering the nature of offence, the accused are
not entitle to enlarge on bail. Accordingly, I proceed to pass the
following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
