ORDER
1. The applicant is praying for return of golden ornaments and
cash seized in the crime by Santacruz Police Station in C. R. No.99/2022
registered u/sec. 381, 411, 34 of IPC.
2. The Investigating Officer has no objection to return the
property to the applicant.
3. Applicant submitted that seized ornaments are belong to her
and were stolen from her house. Crime was registered on her report. In
support of her contention she has produced copy of FIR, seizure
panchanama and Aadhar Card. The concern person from whom the
ornaments were seized gave no objection to return the property to the
applicant. There is no rival claim by any person in respect of the seized
ornaments. No good purpose would serve keeping the ornaments with the
police pending the trial of the case. Applicant is entitled to receive the
seized ornaments on conditions. In the result, following order is passed :
ORDER
1. The custody of golden ornaments and cash seized in the crime
by Santacruz Police Station in C. R. No.99/2022 registered
u/sec. 381, 411, 34 of IPC be returned to the applicant on
furnishing indemnity bond of Rs.35,00,000/.
3. Applicant is directed not to transfer, alter, dispose in any
manner seized property to third person without prior

permission of Court and to produce it before the Court,
whenever required for trial.
4. The investigating officer is directed to take photographs of the
seized ornaments and cash and to produce the same and
indemnity bond along with the final report.
