FURTHER ORDER BELOW EXH.1
1. Perused record, heard learned advocate for the complainant.
2. It is the case of the complainant that he was the owner of the premises in
exchange of new flat has been taken by one of the accused. Initially
complainant himself entered into agreement with builder i.e. proposed Accused
Nos.1 and 2. But later on all the accused persons conspired, forged certain
documents in the name of complainant and fraudulently obtained flat to which
complainant is entitled.
3. After filing of this complaint the verification of the complainant was
recorded and then investigation was ordered as per Section 202 of Code of
Criminal Procedure. The report filed by Investigating Officer. After going
through the report it is clear that using the name of the complainant accused
persons forged several documents and the flat was transferred to Accused
Nos.3 and 4, to which complainant is entitled in substitution of his property
which was part of slum redevelopment scheme, completed by Accused Nos.1
and 2.
4. The findings of Investigating Officer are also, to the same effect.
Though Investigating Officer sought some additional evidence, but the
documents collected by him are enough to draw the inference of prima facie
commission of offence by all the accused persons shaking hands with each
other to defraud the complainant. Therefore, following order -
ORDER
Cognizance of offences punishable under Sections 420 and 467 r/w.34
of Indian Penal Code, is taken. Issue process against all the accused persons for
the said offence.
