ORDER BELOW EXH.1
1. Today, the accused appeared before Jail Court. The accused pleaded
guilty to the offence. He is totally made aware of the consequences of his
pleading guilty to the offence. Despite that he is ready to plead guilty. As such
his plea is voluntary.
2. The accused committed theft of mobile phones and cash, of value of
Rs.1,06,000/-. Heard him on the point of sentence. He is in jail since
22.02.2022. He prayed for leniency. Considering the nature of offence, the
property involved and the period undergone by the accused, following order :
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Sections 380, 457 of Indian Penal
Code and sentenced to suffer rigorous imprisonment for two months for an
offence punishable under Section 380 and 457 of Indian Penal Code. All these
sentences shall run concurrently.
B. Accused is in jail since 22.02.2022, he is entitled to set off as per section
428 of the Code of Criminal Procedure, of the said period. Therefore, accused
shall be released after completion of period of sentence awarded, if not required
in any other offence.
C. The property seized i.e. mobile phone and cash of Rs.90,000/-, shall be
handed over to informant.
D. Copy of this order to be given free of cost to the accused as well as to
the informant Sunita Sagar Tike.
