Order Below Application Seeking Modification of Order, Exh.9
Perused application. Say filed by Ld. A.P.P. Heard both parties.
Accused is charged for the offence punishable U/Sec.279, 337, 338 of Indian
Penal Code. Charge sheet is filed. The accused is released on bail on condition
that he shall not leave India without prior permission of the Court till
conclusion of the trial. According to him he is professional athlic and
frequently travel abroad for tournament. He represents the country in tennis
tournament. Earlier he had been to Africa and Canada for tennis tournament
for three weeks with the permission of this court. He needs to apply for
renewal of passport under Tatkal scheme. He has no antecedents. Therefore,
he prayed for to drop the said condition. The documents at Page Nos.4 and 5
with Exh.A shows the current ranking of accused in men’s single overview and
men’s double overview. It shows he is tennis player. Though there is no clear
documentary evidence to show that he has attended the tournaments in other
countries, the offence is bailable and his mother is an advocate practicing
across Mumbai. Therefore, no scope to apprehend that he will flee away.
Hence, the aforesaid condition can be dropped. Accordingly, I proceed to pass
the following order -
ORDER
1. Application is allowed.
2. The condition seeking prior permission of the Court to travel abroad
is striked out.
