Perused bail application and say. Heard both side. Accused Mr.
Mohd. Ohidur Raheman Mabrul Hussain Choudhari is charged for the
offence punishable U/Sec.309(4) of BNS. Prosecution alleged that,
accused has stolen mobile phone worth Rs.17,000/- by giving dash to
the informant. Said mobile phone is recovered from the accused.
Though charge sheet is filed, offence is non-bailable. After going
through the record it reveals that one similar offence is pending against
the accused. If he is released on bail it would not be safe to public at
large. Considering the modus operandi of the accused he is not entitle
to enlarge on bail. Accordingly, I proceed to pass the following order -
ORDER
1. Application is rejected.
2. Intimation of this order be send to accused immediately
through the Superintendent of Jail.
