ORDER BELOW EXH.1
1. Today, the accused appeared before this court through video
conferencing. The accused pleaded guilty to the offence.
2. He is totally made aware of the consequences of the pleading guilty to
the offence. Despite that he is ready to plead guilty. His plea is voluntary.
3. The accused has stolen two mobile phones and cash, of value about of
Rs.30,000/-. Heard him on the point of sentence. He is in jail since the month
of February, 2021. He prayed for leniency. Considering the nature of offence,
the property involved and the period undergone by the accused, following
order:
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Sections 380 and 457 of Indian
Penal Code and sentenced to suffer rigorous imprisonment for three months for
an offence punishable under Section 380 of Indian Penal Code and rigorous
imprisonment for six months for an offence punishable under Section 457 of
Indian Penal Code. All these sentences shall run concurrently.
B. He is entitled to set off as per Section 428 of the Code of Criminal
Procedure. As he is in jail since 03.02.2021, the punishment has already been
undergone by him, therefore, he shall be released forthwith if not required in
any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
