Cross examination of CW-02- Ajay K. Sharma @ Anantram K. Tiwari by
advocate Mr. S.F.Raheman for the accused :
13. I might have given authority to Mr. Brahaspati Biswas by
my earlier name Ajay K. Sharma. I do not recollect exactly by which
name I had given him authority to represent partnership firm. Our
partnership is by name Ajay K. Sharma. I do not recollect whether
authority letter given to Mr. Briahaspati Biswas was prior to issuing
demand not ice or subsequent to demand notice. It is true to say that
he had no powers to issue demand notice without my authority. I again
say I had given him powers before issuing demand notice. It is true to
say that except authority given vide letter dated 06.03.2021, I had not
given any other authority to Mr. Biswas. It is not true to say that I had
not given authority to file evidence on behalf of partnership firm to Mr.
Biswas. It is true to say that accused had made payment of
Rs.10,75,700/- during 19.04.2017 to 23.06.2021 by IMPS. Said
amount is not concerned with the transaction. It is true to say that I
have not produced any other transaction with the accused against
which I am claiming, receiving aforesaid amount in the proceeding. It is
not true to say that on 1st Dec. 2020 accused has no liability to pay the
cheque amount of Rs.11 lakhs. I can produced my bank account
statement and account statement of M/s. Comfort Caterers. I have
already produced it on record at Exh.42. I will produce my personal

bank account statement on next date.
On oral request of the advocate for the accused cross
examination is deferred till next date.
