Perused the record. It appears that the chargesheet is filed
u/sec.65(e) of the Bombay Prohibition Act. The record further shows
that till today, police machinery miserably failed to execute NBW on
both accused. Sufficient and considerable opportunity as well as time is
given to police machinery. Case is 5 years old. Hence, in such situation,
no purpose will be served by keeping it pending. Therefore, in such
facts & circumstances, the proceeding of the case is stopped u/sec.258
of the Code of Criminal Procedure. The accused are acquitted and their
bail bonds, if any be canceled. The seized muddemal i.e. country liquor
be forwarded to Excise Department and seized Maruti Alto car bearing
No. MH02KA943 be returned to the original owner after due
verification and after the appeal period is over. It be closed.
