ORDER BELOW EXH.1
1. Today, the accused appeared before jail court at M.C.P. Arthur Road,
Mumbai. The accused pleaded guilty to the offence.
2. He is totally made aware of the consequences of the pleading guilty to
the offence. Despite that he is ready to plead guilty. His plea is voluntary.
3. Heard him on the point of sentence. He prayed for leniency. Accused is
in custody since 03.02.2025. Accused had stolen the scooter, bearing
registration No.MH-01-DU-3980, of value of Rs.35,000/- and he is in jail for
about one month. Therefore, considering the nature of offence and his prayer,
following order :
ORDER
A. The accused is convicted under Section 264 of the Bharatiya Nagarik
Suraksha Sanhita 2023, for an offence punishable under Section 305(b) of
Bharatiya Nyaya Sanhita and sentenced to suffer simple imprisonment for one
month.
B. Accused is entitled to set off as per Section 468 of the Bharatiya Nagarik
Suraksha Sanhita 2023. As he is in custody since 03.02.2025, the major part of
punishment has already been undergone by him and shall be released after
undergoing punishment as ordered, if not required in any other offence.
C. The property seized shall be handed over to informant.
D. Copy of this order to be given free of cost to the accused.
