Order Details: Order Below EX 1 Pdf Text: IN THE COURT OF METROPOLITAN MAGISTRATE, 12TH COURT, BANDRA, MUMBAI Notice Case No.122/N/2018 (C.C. No.1290/PW/2016) Bandra Police Station ORDER BELOW APPLICATION FOR PERMISSION TO TRAVEL ABROAD 1] This is an application filed by applicant/accused Riyat Ali Ismail Hamdare who is accused in above case registered by Bandra Police Station. 2] It is stated that the applicant wish to visit Saudi Arab (Makkah Madina) for purpose of Umara/Pilgrimage for the period from 28/03/2018 to 15/04/2018. He has annexed xerox copy of ticket, hotel booking receipt etc. on record. 3] On the application, say of Ld. APP was called. Ld. APP filed her say and submitted that the case is u/s.354(A), 509, 504, 506, 34 of the I.P.C. The accused have not furnished the address and contact number of the place where he wants to visit in the application. Hence, the application is opposed. 4] Perused the application, say filed by Ld. A.P.P. and documents annexed with the application. I do not find that the progress of the case would hamper, during that span of time if the accused is granted permission to go abroad subject to some condition that he would not dispute his identity as a particular accused in the case and that an Advocate on his behalf would remain present in the Court. Hence, the following order. ORDER i] The application is allowed. -- 1 of 2 -- ii] Permission is granted to the applicant/accused Riyat Ali Ismail Hamdare to travel abroad for the period from 28/03/2018 to 15/04/2018 with condition that he shall not misuse the said permission obtained by her. iii] As a condition precedent, he shall furnish undertaking in writing that he shall, remain present if required by this court to appear before it at any time during the continuance in force of the Passport so issued by Passport Authority. iv] The applicant is directed to deposit cash of Rs.10,000/ (Rupees Ten Thousands only) against security for the same, and he can withdraw it after his arrival.
