Heard advocate for complainant. Accused and advocate absent.
Plea of accused recorded at Exh.15 on 16.05.2023. Accused failed to
exercise right of cross examination despite giving sufficient opportunity
and his right was closed vide order dated 16.09.2025. In view of
section 143(3) of Negotiable Instrument Act, complainant has right to
speedy trial. Hence, I pass following order.
ORDER
1) The Bail Bonds of the accused stands cancelled.
2) The amount of cash bail if any deposited by the accused
is forfeited and be credited to the Government Account.
3) The statement of accused to be recorded under section
313 of Code of Criminal Procedure stands dispensed
with.
4) Issue standing NBW against accused for securing his
presence.
5) Matter be posted for filing written notes of arguments by
the complainant on next date.
6) Order dictated and pronounced in open court.
7) Order be uploaded on CIS for the knowledge of the
parties.
