ORDER BELOW EXH.1
Read complaint. Perused documents placed on record. Heard
Ld. Advocate Shri Harshit Gudhka for the complainant.
2. According to complainant accused No.1 to No.4 fabricated the
false bank guarantee dated 21/02/2022, which alleged to have been
issued by the ICICI Bank, Kalyan branch, which support to be presented to
the Government of Goa. It is contended that, accused by joining hands
with each other deceived the complainant and caused damages.
3. It is the contention of complainant that, he made complaint to
Economic wing, but no action has been taken, therefore, the complainant
constrained to file the present complaint and prayed for the investigation
as per the provision of section 156 (3) of the Code of Criminal Procedure.
4. I have gone through the contents from the complainant and
perused the record. The complainant is having the documents upon which
he can make out the case against accused persons. The entire
complainant’s case is based on documents which the complainant is
having possession. Therefore, I am opinion that, it is not a fit case for
sending the same for investigation under section 156 (3) of Code of
Criminal Procedure. Therefore, prayer to that effect is hereby rejected and
the matter be kept for recording verification statement of the complainant.
