ORDER BELOW EXH.1 IN C.C.NO. 794/PS/2023
Perused the record. It appears that the chargesheet is
filed u/sec.65(E), 92, 108 of the Bombay Prohibition Act. The record
further shows that till today, police machinery miserably failed to
execute summons on accused. Sufficient and considerable opportunity
as well as time is given to police machinery. Case is 3 years old. C.A.
report is not filed on record.
Hence, in such situation, no purpose will be served by
keeping it pending. Therefore, in such facts & circumstances, the
proceeding of the case is stopped u/sec.258 of the Code of Criminal
Procedure. The accused is acquitted and his bail bonds, if any be
canceled. The seized liquor be forwarded to Excise Department and
remaining muddemal be destroyed and KTM motorcycle bearing No.
MH-02-FF-1586 be returned to it’s original owner, after due verification.
