ORDER BELOW BAIL APPLICATION NO.1192/2022
(Accused No.4, Neeraj Dashrath Bishnoi)
1. The present application filed under Section 437 of Code of
Criminal Procedure for regular bail. Heard Ld. Advocate for the
applicant/accused. Heard Ld. Special Public Prosecutor.
2. Perused record. Perused say filed by Ld. Special Public Prosecutor
and Investigating Officer.
3. The summary of the grounds for bail pleaded by the accused is that
he is innocent. No offences charged with are made out even if the whole
final report accepted as it is. Investigation is completed and charge sheet
is already filed. Accused is ready to remain abide by the conditions. He is
permanent resident of Jorhat, Asam, etc.
4. Ld. Special Public Prosecutor strongly objected to it stating that
prima facie active involvement of the accused noticed in the incidence.
All the offences made out. The released of accused is prejudicial to the
further progress of the matter. There is possibility of tampering and
repetition, therefore, application shall be rejected.
5. Much has been discussed by this court in its order dated
12.04.2022, while deciding bail applications of other accused persons.
The accused is the main person who developed disputed application and
instigated other persons to join him and commit the acts leading to
offences. The act committed by the accused is serious. There is possibility
of tampering and his non-appearance to face trial. For these reasons and
reasons mentioned in the order dated 12.04.2022, for rejection of bail
applications of accused Omkareshwar Thakur and Neerajkumar Nunwa
Singh, the present application also needs to be rejected. Accordingly
following order -
