Read substitution application. Perused proceeding. Record shows
that complainant failed to take necessary steps to proceed further with
the complaint despite giving sufficient opportunity. Present application
is moved after more than four years of filing complaint. The lethargic
approach on the part of complainant has kept the proceeding as it is at
pre cognizance stage.
2. However, looking into present application, complainant
needs to be given one more last opportunity to go with the proceeding.
Substitution of newly authorized representative will not caused
prejudice to the other side at this stage. Hence, I pass following order.
ORDER
1. Substitution Application is allowed subject to cost of Rs.1,000/-
to be paid to legal Aid Fund.
2. Costs are condition precedent to exercise further rights.
3. Order dictated and pronounced in open court.
4. Order be uploaded on Court Web Portal.
