ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
CRIME NO.34/2021, NOTICE NO.246/N/2021 OF SANTACRUZ
POLICE STATION
1. The present application is filed for return of vehicle i.e.
Honda CB Shine Motor cycle bearing No.MH02FF6607, seized by the
Santacruz police Station in C.R.No.34/2021 registered u/sec.279, 338
of IPC and sec.134 of M.V.Act.
2. The Investigating Officer has No objection to return the
vehicle.
3. The applicant claims that he is the owner of the said
vehicle. He has produced copies of FIR, registration certificate,
insurance policy and Aadhar card in support of his version. No one else
has claimed the custody of the said vehicle. There is no likelihood that
the trial will commence and conclude in near future. The vehicle may
get damaged if remained in idle condition for long period. It will be
proper to return the seized vehicle to the applicant by imposing
conditions. As such following order is passed:
ORDER
1. The custody of Honda CB Shine Motor cycle bearing
No.MH02FF6607, seized by the Santacruz police Station in
C.R.No.34/2021 registered u/sec.279, 338 of IPC and sec.134 of
M.V.Act be handed over to the applicant.
2. The applicant to execute Indemnity bond of Rs.80,000/.
3. The applicant is directed not to sell, transfer, alter, dispose
or hand over the seized vehicle to third person without prior permission
of court and to produce the concerned vehicle before the Court,
whenever required for trial.
4. The Investigating Officer is directed to take the

photographs of the seized property, at the cost of the applicant and to
produce the photographs and Indemnity Bond with the final report.

OF BKC POLICE STATION
1. The present application is filed for return of Suzuki Access
125 Two Wheeler bearing No.MH03DD5685, seized by the BKC
police Station in C.R.No.104/2019 registered u/sec.279, 336 of IPC and
Rule 15/177 of M.V. Act.
2. The Investigating Officer filed his say and given no
objection to return the seized vehicle to the applicant. The investigating
officer also submitted correction report regarding the registration
number of the vehicle.
3. The applicant claims that she is the owner of the said
vehicle. The applicant has produced copy of FIR, Insurance policy,
aadhar card and Certificate of Registration in support of her version.
The accused has given no objection to hand over the vehicle to the
applicant. No one else has claimed the custody of the said vehicle.
There is no likelihood that the trial will commence and conclude in near
future. The vehicle may get damaged if remained in idle condition for
long period. It will be proper to return the seized vehicle to the

1. The present application is filed for return of Bajaj Auto
Rickshaw bearing No.MH02EW6287, seized by the Santacruz police
Station in C.R.No.146/2019 registered u/sec.379 of IPC.
2. The Investigating Officer has no objection to return the
vehicle to the applicant.
3. The applicant submitted that he had given the said Auto
Rickshaw to Rahul Singh to use. It was stolen. Rahul Singh lodged
report regarding theft. The applicant claims that he is the owner of the
said vehicle. The applicant has produced copy of FIR, Insurance Policy,
Certificate of Registration, Permit and Aadhar card etc. in support of his
version. He has also produced no objection from Rahul Singh to hand
over the vehicle to him. No one else has claimed the custody of the said
vehicle. There is no likelihood that the trial will commence and
conclude in near future. The vehicle may get damaged if remained in
idle condition for long period. It will be proper to return the seized
vehicle to the applicant by imposing conditions. As such following order
is passed:
ORDER
1. The custody of Bajaj Auto Rickshaw bearing No. MH02
EW6287, seized by the Santacruz police Station in C.R.No.146/2019
registered u/sec.379 of IPC be handed over to the applicant.
2. The applicant to execute indemnity bond of Rs.1,50,000/.
3. The applicant is directed not to sell, transfer, alter, dispose
or hand over the seized vehicle to third person without prior permission
