Cross examination of CW-01- Idris Abdul Razzak by advocate Mr. Anup
Pandey for the accused :
13. I am studied upto HSC. I was doing construction business
in the month of April 2016. It was my individual business. There were
only two bank accounts maintained by me in between April 2016 to
August 2016. I can produce the bank statement of said period if
received from the bank. I have filed Income Tax Returns for the
Assessment Year 2016-2017. I do not remember what income was
shown by me. During said period I was earning approximately
Rs.1,50,000/- per month. It is true to say that I do not possess any
document with me to show the particular amount given in cash to the
accused. It is not true to say that as I have not given any amount to the
accused in cash, I do not possess any such document.
14. I do not know that accused has filed police complaint
against me on 05.11.2018. It is not true to say that accused had filed
complaint against me as I obtained the cheque forcibly from the
accused taking gundas to his house. I know Hanif Qureshi @ Hanif
Uncle. He is no more. I have met him in the year 2018 and 2019. He
had called me to meet him. I know the accused since so many years.
There was no talk in between me and accused about development of
property. There was no talk in between me and accused about
development of property belonging to Lucy D’souza. Witness volunteers

that I am developing her property and in that connection I had given
money to the accused. I am developing said property since year 2012.
It is not true to say that for liaising of said property development I
contacted with the accused. It is not true to say that I was agreed to
give Rs.1.50 crores to the accused against the work of Liaising work
such as obtaining permissions, sanctions from requisite Government
Departments. It is not true to say that accused has prepared the
building plan for the property of Lucy D’Souza bearing CTS No.6901 at
Kolekalyan Village. It is true to say that I had given Rs.9 lakhs to the
accused. It is not true to say that said amount of Rs.9 lakhs was spent
for Liaising work. It is true to say that for said work of liaising some
writing was written on a paper in the hand writing of accused on
26.04.2016 and I had signed it. It is true to say that said Agreement or
Contract is not terminated by me.
15. I have not annexed acknowledgment card with the envelop
of notice sent by registered post. I do not know that accused has not
received demand notice.
On oral request of the advocate for the accused cross
examination is deferred till next date.

16. I do not remember in which banks I had maintained my
two bank accounts in between April 2016 to August 2016. It is true to
say that I am not aware the name of the bank and as such I have not
produced the Bank Account Statements. It is not true to say that I have
not given any money in between April 2016 to August 2016 to the
accused and as such I have not produced the Bank account Statement.
It is not true to say that the cheque Exh.21 was not issued in discharge
of any liability towards accused.
