ORDER BELOW APPLICATION FOR REGISTRATION OF DEATH.
1] The said application is filed by applicant Raju David Pandit in
context of his brother Shamuvel David Pandit who expired on 14/03/2017 at
above mentioned address. Due to ignorance the applicant could not get register
death of his brother to the B.M.C. office within stipulated period.
2] The respondent i.e. Medical Officer of Health, G/North Ward,
Dadar W, Mumbai has filed report and submitted that the death of deceased
Shamuvel David Pandit on 14/03/2017 is not registered with their office. The
said officer further submitted that to scrutinize the case and necessary order be
passed.
3] Alongwith this application the applicant has filed on record his
own affidavit stating every facts as per his application and enclosed copies of
his PAN Card, Aadhaar Card, ration card and medical certification of cause of
death, death report of deceased Shamuvel David Pandit. The applicant has filed
on record affidavits of witnesses namely Alfa Raju Pandit and Sachin Suresh
Salve who on oath stated to have been present at the time of funeral of

deceased Shamuvel David Pandit on 14/03/2017. Verified Aadhaar Card copies
of witnesses are filed on record as proving of their identify and address. Also,
the applicant has filed on record affidavits of Tereja Sham Pandit – wife of the
deceased and Sunil Sham Pandit – son of the deceased. Verified copies of
Aadhaar Cards are filed on record as proving of their identify and address.
4] On perusing the application, affidavit, documents of the applicant
in support of his application, affidavit of witnesses and report of B.M.C., this
Court does not find any hesitation to accept that 14/03/2017 is true and
correct date of death of Shamuvel David Pandit – brother of the applicant.
Hence, proceed to pass following order.
ORDER
1 Application is allowed.
2 The concern authority 'The Registrar, Birth and Death, G/North
Ward, Dadar W, Mumbai400 028 is directed to take entry of the date of death
i.e. 14/03/2017 (Fourteen March Two Thousand Seventeen) of Late Mr.
Shamuvel David Pandit – brother of the applicant, in their register on accepting
the fees as per the rules.
