I solemnly affirm on oath that -
My name is Ajay Kangutkar
Age : 36 years,
Occupation : Officer, Bank of Baroda, Jogeshwari (W) branch, Mumbai
R/o. Borivali(E), Mumbai.
Examination-in-Chief of DW-02 by advocate Anup Sharma for the
accused :
1. Today I am present to depose on behalf of the bank. I have
received the witness summons.
2. I am producing Authority letter issued by Chief Manager to
authorize me for deposing on behalf of bank. Now I am shown
Authority Letter. It bears signature of our Chief Manager. Authority
Letter is marked Exh.42. I am also producing certified copy of Bank
Account statement for M/s. Shibani Trust for the period 01.11.2019 to
24.02.2026. The entries in the Bank Account Statement are true and
correct. It bears signatures of our Branch Head and seal of the bank.
Bank Account Statement is marked Exh.43. I have also produced
certified copy of cheque No.178401 dated 08.11.2019 issued in favour
of East West Travel and Tours by Shibani Trust. It bears signature of our
Branch Head and seal of the bank. The cheque is marked Exh.44. I have
also produced certified copy of cheque No.217599 dated 10.01.2020
issued in favour of East West Travel and Tours by Shibani Trust. It bears
signature of our Branch Head and seal of the bank. The cheque is
marked Exh.45. I know signature of our Branch Head out of daily
correspondence. The cheque Exh.44 is cleared on 12.11.2019. Amount
of Rs.9 lakhs is credited to the account of East West Travels. Another
cheque Exh.45 for Rs.8,49,000/- is cleared on 14.01.2020 and the

amount is credited to the account of East West Travels.
Cross examination by Adv. Mr. Madhav Kulkarni for the complainant:
3. I am working in the branch since 2018. I can not tell the name
of director or Trustees of Shibani Trust. It is true to say that accused
Manisha Mukharji is one of the Trustee of Shibani Trust. It is true to say
that I can not tell for what reason or purpose those cheques were
issued.
