ORDER PASSED BELOW EXH.1
This application is filed by the applicant namely Mobin
Mohamed Habibullah Shaikh for release of TATA goods truck bearing
No.MH02ER9313, which is seized by the Kherwadi in connection with
Crime No. 50/2022 registered with said police station for the offences
punishable under section 304A, 279 of IPC and section 184 of M.V. Act.
2) Say was called from I. O. and A.P.P. I.O. has no objection. The
Ld. APP has an objection and submitted that said muudemal is essential at
the time of trial. She prayed for rejection.
3) In support of his contention regarding ownership, applicant has
filed on record verified copies of RC book & permit and xerox copy of
Aadhar card alongwith his affidavit. The name of applicant on exhibit No.1
is Mobin Mohamed Habibullah Shaikh but the names on RC book and
Aadhar card are different from applicant's name. Therefore, he is not

entitled to get the custody of the vehicle. Under such circumstances, I pass
following order :
