ORDER IN C. C. NO.150/N/2020
1. The applicant is praying for return of amount of Rs.
2,00,000/ seized by Santacruz Police station in crime No. 74/2020,
registered u/sec.420, 34 of IPC.
2. The I.O. has filed say. He has not objection to return the
amount to the applicant.
3. Notice was issued to accused Pawan Kumar Pandey. The
report shows that it was delivered to him. However, the accused did not
appear to raise objection.
4. The applicant submitted that the accused obtained the said
amount from him under pretext of offering role for him in bollywood. He
lodged report about the incident. He is entitled to the amount seized by
the police. He has produced copy of FIR and Aadhar Card in support of his
claim.
5. A copy of seizure panchanama was called for reference. It
appears from the said panchanama that the abovementioned amount was
seized from the wife of the accused at the instance of the accused. The
panchanama contains denomination and numbers of currency notes seized.
It can be considered for reference in the case. No one else except the
applicant has claimed the said amount. It will not be proper to keep such
huge amount at the police station. It may be handed over to the applicant
by imposing conditions. In the result, following order is passed :

ORDER
1. The application is allowed.
2. The amount of Rs. 2,00,000/ seized by Santacruz
Police station in crime No. 74/2020, registered u/sec.420, 34 of IPC
be given to the applicant.
3. The applicant is directed to furnish indemnity bond of
Rs.2,00,000 /.
4. The applicant is directed to furnish said amount before the
Court, whenever required for trial or other proceeding.
5. The investigating officer should furnish the indemnity bond
alongwith the final report.
