1] This is summons case u/s.185, 3 r/w.181 of the Motor Vehicle Act.
The accused is/are absent from the court from filing of the chargesheet.
Repeatedly warrants are issued. Warrant remains unserved as accused has not
residing on the address and no whereabout of the accused found. The case is
filed in the year 2016 and prosecution has failed to secure the presence of
accused. The case is pending in the court for trial from the year 2016. As
accused is not trace and not found, therefore, no purpose would be served by
keeping the matter pending in the file. Therefore, this is fit case to exercise
power u/s.258 of Cr.P.C. Hence, the following order.
ORDER
a] The proceeding of this case has been stopped u/s.258 of Code of
Criminal Procedure. The accused stands discharged. His/Their bail bond stands
cancelled. The cash amount if any be forfeited and credited to Government as
per rule.
