ORDER C. C. NO. 149/N/2020
1. The applicant is praying for return of broken mangalsutra
seized by Kherwadi Police station in course of investigation in C.R.No.
247/2019 which is property in C.R. No. 571/2019 registered with Vakola
Police Station u/sec. 392, 279 of the IPC.
2. The P.S.O. of Kherwadi Police station filed say and stated that
golden ingot worth 79.300 grams has been seized. He has given no
objection to hand over it to the applicant.
3. The applicant submitted that her mangalsutra was snatched by
motor cyclist while she was traveling by auto rickshaw. It was broken and
half of it remained with her whereas remaining portion was robbed by the
motor cyclist. She lodged report about robbery. The applicant is claiming
back her part of the mangalsutra which was robbed. However, the
mangalsutra is not seized in the case. It is an ingot which has been seized.
The description of the property which is claimed by the applicant differs
from description of the property which is seized. Therefore, the prayer of
the applicant cannot be considered. Hence, following order is passed :
