B.A. NO.643/2022 IN C. R. NO. 57/2021 (Cyber P.S.)
1. Perused record. Heard both the sides.
2. The accused prayed for bail mainly on the ground that he is innocent
and falsely implicated in the matter. There are dependents on him. There
found no evidence against the accused even after conclusion of investigation.
He is ready to remain abide by the conditions. Allegations are not much
serious, besides other grounds. Ld. A.P.P. objected to it stating that
investigation is over, sufficient material found against the accused and no case
of bail made out. Therefore, application shall be rejected.
3. Accused is in custody since 17.12.2021, in connection with the present
matter for an offence punishable under Sections 500, 506(2) of Indian Penal
Code and Section 67 of Information Technology Act. His first bail application
was rejected before the conclusion of investigation. Now charge sheet is filed
and investigation is over. The perusal of whole record of investigation reflect
remote connection of the accused with the alleged acts of threat. Allegations
are not much serious. Accused is ready to remain abide by the conditions. The
objection raised are also not much serious. There are dependents on the
accused, the other apprehensions expressed about the possibility of tampering
and appearance during trial can be addressed by imposing certain conditions.
Considering all these facts and circumstances and grounds assigned,
following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.15,000/-. Permission granted to deposit cash surety instead of surety bond.
c. Accused person shall furnish his detail address and proof thereof and
shall not tamper with prosecution.
