ORDER BELOW EXH.1 IN C.C.NO. 484/PS/2021
Perused the record. It appears that the chargesheet is filed
u/sec. 122 (e) of Mumbai Police Act. The record further shows that till
today, police machinery miserably failed to execute summons on
accused. Sufficient and considerable opportunity as well as time is given
to police machinery. Case is 1 year old. Hence, in such situation, no
purpose will be served by keeping it pending. Therefore, in such facts &
circumstances, the proceeding of the case is stopped u/sec.258 of the
Code of Criminal Procedure. The accused is acquitted and his bail
bonds, if any be canceled. Seized Screwdriver be sold in public auction
and sale amount be forwarded and credited to Government. It be
