Order below report of Excise Inspector, (U) Division
(O.W. No.DET 112020/102/K, dated 17.02.2020)
This is the report seeking to auction the seized articles and
liquor bottles liable for confiscation. All the cases are disposed of in the
year 20142015 vide section 258 of Cr.P.C. The report of Judicial Clerk
was called and APP was directed to argue. J.C. submitted report that all
the cases are disposed off vide section 258 of Cr.P.C. The APP failed to
argue the report. The fact is that the cases were already disposed of.
Therefore, it is just and proper to allow the Excise Department to
auction the articles, as per law and to deposit the credit with the
Government. The seized liquor bottles be confiscated to Government
and be disposed of, as per law. Accordingly, permission granted subject
to any order already passed while disposing the case. Report
compliance. Inform accordingly.
