Cross examination of CW-01- Junaid Badgujar by advocate K.M.Yadav
for the accused :
25. I was running business in the name of Mi Amigos Cafe
since 2019 but in September 2021, I started practicing as an advocate.
The business in the name of Mi Amigos Cafe was partnership business.
Documents pertaining to business such as licence was in my personal
name. It is true to say that I have not enclosed any documents related
to said business alongwith my complaint. I can tell names of other
partners engaged with said business. Mr. Nikhil Ruparel, Mr. Bhagirath
Chokshi and Mr. Asif Zindran were my partners. Said business under
partnership was registered partnership firm but due to COVID
registration was delayed. It is true to say that I have not produced any
document of partnership firm alongwith my evidence affidavit.
Partnership business in the name Mi Amigos Cafe is not in operation as
on date. I left restaurant in the year 2021. Thereafter, they continued
for more than 6 months. Later on I am not aware when business was
closed. It is not true to say that I was never engage in the business of
restaurant by name Mi Amigos Cafe.
26. I met with accused through my friend Nikhil Ruparel.
Partnership firm Mi Amigos Cafe was filing Income Tax Returns. Said
firm has filed Income Tax Returns when I was engaged in the business.
It is true to say that I have not produced Income Tax Returns with

affidavit. It is not true to say that my firm was not filing any Income
Tax Returns.
27. I have visited Chemist of the accused multiple times. Mr.
Pawan Sethi alongwith his father was running both Chemist shop. I
have not checked before advancing amount of loan whether they are
owner or Proprietor of the business. Contents of para 5 of my evidence
affidavit are true. I lent money on sympathy with accused for
expanding business. I had asked him where he want to expand the
business. I have not demanded any documents of his proposed
expansion of business. It is not true to say that accused never requested
or proposed me to grant friendly loan of Rs.10,50,000/-. It is not true
to say that I am deposing false that I shown sympathy and agreed to
provide said loan to the accused and which was handed over to him in
April 2021.
Cross examination is deferred till next date as Court Recess
time.
