Order below application seeking permission for going abroad
1. Perused the record. Heard both the sides. The prosecution mainly objected
only on the ground that presence of accused is necessary for trial, he may
abscond, hence application shall be rejected.
2. From the contents of the application it is clear that accused is temporarily
leaving India and ready to remain abide by the conditions. So also accused is
ready to proceed with the matter in his absence through his counsel.
3. Considering these aspects and the reasons assigned for leaving India
temporarily there is no hindrance in allowing the application by imposing
certain conditions. Therefore, following order :
ORDER
1. Application is allowed.
2. Applicant/Accused No.1, Mr. Saifuddin Imtiyaz Shaikh, is permitted to
leave India for Dubai from 16.12.2021 to 28.12.2021.
3. Applicant/Accused No.1, Mr. Saifuddin Imtiyaz Shaikh, shall furnish his
detailed itinerary, his residence address in Dubai.
4. Accused shall take note that no adjournment shall be granted to him for
any reason and on the ground of his absence for trial and shall not dispute his
identity during trial.
