Cross examination of CW-1 – Smt. Sngeeta Nitin Sathe by advocate Mr.
Milind Gaware for the accused :
13. I have read my evidence affidavit. The business of providing
THR powder making machinery and raw material is not run in individual
name. It is run under the Mahila Bachat Gat Programme. Name of my Mahila
Bachat Gat is Sunny Mahila Bachat Gat. I am Secretary of Sunny Mahila
Bachat Gat. It is registered in the year 1995. I am Secretary since year 2006.
It is true to say that I have not produced any document showing Sunny
Mahila Bachat Gat purchased the machinery of THR Powder making. It is
true to say that I have not produced any document to show that Sunny
Mahila Bachat Gat purchased THR raw material from Government in the year
2020. It is true to say that I am not doing business of providing THR Powder
making machinery and raw material for making THR Powder individually in
my own name. In the year 2020 I had seen documents pertaining to
registration of accused NO.1 Bachat Gat and accused No.2 as its President. I
can not tell the Executive office bearers of accused No.1 Ansha Mahila
Bachat Gat in the year 2020. It is true to say that in the year 2020 I have not
met any office bearers of accused No.1. I have not obtained any Resolution
passed by accused No.1 for purchasing THR powder making machinery and
raw material in the year 2020. I had asked said Resolution with accused in
the year 2020.
14. It is true to say that the Agreement produced at Exh.16 is not
executed in between Sunny Mahila Bachat Gat and Ansha Mahila Bachat
Gat. It is true to say that in said Agreement it is not mentioned that I am

executing Agreement on behalf of Sunny Mahila Bachat Gat. It is true to say
that the signature of accused No.2 on Agreement Exh.16 is endorsed in the
capacity of President of Ansha Mahila Bachat Gat. I am not possessing any
Bills for purchase of machinery for making THR Powder and allied material. I
do not remember exact date of tender received by Ansha Mahila Bachat Gat
from Government for supplying THR Powder but it was in the year 2020. It is
not true to say that Government supplies the material for manufacturing THR
Powder. Government is supplying only Wheat. I can not tell for what amount
Ansha Mahila Bachat Gat raised the bill with Government in the year 2020-
2021. I can not tell the amount of bill raised by Ansha Mahila Bachat Gat to
the Government. Subject cheque Exh.17 is not issued against payment of any
bill as per condition No.5 of the Agreement Exh.16. It was given against
price of machinery and expenses of material. It is true to say that I have not
produced any bill showing amount of Rs.5 lakhs spent on any machinery or
material. It is true to say that I have not sold any machinery to the accused
No.2 in the year 2020. It is true to say that I have not sold any material for
manufacturing THR Powder in individual capacity to accused No.2 Pushpa
Sunil Raut in her personal capacity. It is true to say that I do not possess any
documentary evidence to show that Ansha Mahila Bachat Gat is liable to pay
me Rs.5 lakhs in the year 2020. It is true to say that even I am do not posses
any documentary to show that Pushpa Sunil Raut is liable to pay Rs.5 lakhs
in the year 2021. It is true to say that I do not posses any documentary
evidence pertaining guarantee taken by accused No.2 to pay legal debt of
accused No.1 on its behalf. It is true to say that I personally in individual
capacity or on behalf of Sunny Mahila Bachat Gat has not raised any bill for
Rs.5 lakhs in the year 2020-2021 to Ansha Mahila Bachat Gat. It is true to
say that I do not have any documentary evidence to show that Ansha Mahila
Bachat Gat or accused No.2 is liable to make payment of Rs.5 lakhs to me on
07.12.2021.

15. It is true to say that cheque Exh.17 pertains to personal bank
account of accused No.2. It is not true to say that I was aware of making stop
payment by drawer pertaining to cheque Exh.17. It is true to say that
Agreement Exh.16 condition No.5 indicates that 10 cheques of Ansha Mahila
Bachat Gat was given to me. I have not deposited any cheque issued/drawn
on account of Ansha Mahila Bachat Gat for realization.
16. Now I am shown cheque Exh.17. It is true to say that the ink of
signature on the cheque is different than the ink of rest of the contents and
hand writing over the cheque. I knowing husband of accused No.2. It is true
to say that cheque Exh.17 was given to me on the date of execution of
Agreement Exh.16. It is not true to say that cheque Exh.17 was given to me
by Sunil Raut, husband of accused No.2. It is true to say that accused No.2
Pushpa Sunil Raut was not liable to pay me any amount on 07.12.2021. It is
not true to say that I have misused the blank cheque filling contents. It is not
true to say that accused is not liable to pay me any amount. It is not true to
say that therefore, accused instructed her banker to stop the payment. It is
not true to say that I have filed false case against accused without any
liability. It is not true to say that accused No.1 Ansha Mahila Bachat Gat is
also not liable to pay me any amount. It is not true to say that the contents of
rejoinder given to notice reply by me are false. It is not true to say that I do
not possess any documentary evidence to show that the rejoinder given to
notice reply was received by the accused.
