Complainant absent since last so many dates. His advocate on record
Mr. U.K.Tripathi also absent. Application for adjournment moved by advocate Mr.
R.S.Tripathi, who is neither advocate on record nor possess any authority to
represent complainant is rejected considering absence of accused. Complainant
was already granted last chance by imposing costs to be paid to legal Aid Fund
on 28.01.2025.
2. The case is pending since year 2020 for recording verification
statement of the complainant and thereafter conducting inquiry under section
202 of Code of Criminal Procedure. Accused No.1 is residing outside the
jurisdiction of the court. Advocate for complainant filed several applications for
adjournment through his Junior advocate and sought adjournments. Today again
adjournment application Exh.9 was moved on behalf of the complainant, which
is rejected. No further steps taken till date by the complainant despite giving
sufficient opportunity. There is nothing on record in compliance of inquiry to be
conducted under section 202 of Code of Criminal Procedure. There is no material
on record to take cognizance of the complaint without recording verification
statement of the complainant. Keeping the file pending years together without
proceeding further taking appropriate steps by the complainant is unjustified.
3. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case and as such

remained absent for verification. Hence, I pass following order.
ORDER
1. Complaint is dismissed under section 203 of Code of Criminal
Procedure.
2. Proceeding stands closed.
3. Order dictated and pronounced in open court.
