REASONS
The accused No.1 is produced before the me though V.C. today.
The accused has sent application from the prison for pleading guilty, which
is at Exh-8. Accused is in jail since 25.01.2020 to 24.03.2020 and then
from 24.06.2026 to till date.
Heard the accused in person. He submitted that, lenient view
may be taken as he is the only earning member of his family. Considering
the nature of offence, antecedents of accused, age of accused and the
period of detention already undergone, pass following order :-
ORDER
i) Accused Suraj Santosh Yadav @ Babu Kanda is convicted under
section 241 of Criminal Procedure Code for the offence
punishable u/sec. 380 of Indian Penal Code. He is sentenced to
suffer R.I. for Five (5) months and fine of Rs. 1,000/- in default
of payment of fine, he shall undergo further S.I. for 1 day.
ii) Accused is in jail since 25.01.2020 to 24.03.2020 and then
from 24.06.2026 to till date. He is entitled to get benefit of set
off for the period of detention already undergone vide under
section 428 of Cr.P.C.
iii) The possession of already returned seized i-phone 10, I-phone
be returned to it’s original owner, after due verification.
iv) Copy of this judgment be supplied to accused free of cost.

v) Case is disposed off.
