ORDER BELOW EXH. 1
1. Perused record. Heard both the sides.
2. This is an application under Section 480 of Bhartiya Nagrik Suraksha
Sanhita (B.N.S.S.), for bail. Accused prayed for bail mainly on the ground
that he is poor and innocent. Investigation relating to him is over. The
allegations are false. He is ready to remain abide by the conditions, if any,
imposed, etc. Ld. A.P.P. objected to it stating that offence is serious. There
is possibility of tampering and absconding, etc.
3. Accused is in custody for sufficient time. The investigation is over
and chart sheet already filed. So also the contraband already seized. From
the record it is clear that the possibility of absconding or tampering is almost
nil. Offence is triable by this Court itself. Accused is ready to remain abide
by the conditions. He is resident of place situated within the jurisdiction of
this court itself. The conclusion of trial will take much time. Accused is
ready to remain abide by the conditions, if any, imposed.
4. Considering reasons mentioned in the application and above
discussed aspects of the matter, the application needs to be allowed, hence
order -
ORDER
a. Application is allowed. Accused is released on bail on her furnishing
P.B. and S.B. of Rs.15,000/-.
b. Permission granted to deposit cash surety instead of surety bond.
Accused shall furnish his detail address and proof thereof.
