ORDER BELOW BAIL APPLICATION OF ACCUSED –
ABBU AHMED KHAN @ TAMBI
1. Perused and read application with say of Ld. APP. Heard both
advocates at length. They have argued as per their stands.
2. As per remand report, the accused accused is produced me.
On 29.01.2026, the accused filed bail application on record.
3. As per remand papers, accused is found in possession of 226
Grams Ganja. He was thus arrested and produced before the court. He is
remanded in MCR. Accused sought bail on usual grounds.
4. Both I.O. and Ld. APP have objected the application on the
ground that there is recovery from the accused. It shows prima-facie
involvement of the accused in the crime. Investigation is in progress and
charge-sheet is not filed. If accused is released on bail, it will hamper
the investigation. They prayed for rejection.
3. The quantity of Gard powder is a small quantity and it is
triable by J.M.(F. C.) In view of nature of offence, punishment provided
and no other antecedents, so also, age of accused, there appears no
reasonable ground to deny bail. Bail is a rule and jail is an exception.
Liberty of a person is the constitutional guaranteed right. Hence, the
application is allowed on following conditions :-

ORDER
i) Accused be released on bail on his executing PB & SB of
Rs.15,000/- or PB of Rs.15,000/- and cash bail of
Rs.8,000/-.
ii) The accused shall not commit the similar offence.
iii) Accused shall attend concerned police station on every Friday
between 11.00 p.m. to 2.00 p.m., till filing of final report.
