ORDER BELOW EXH.-1
Today the applicant Lata Rahulkumar Patel is present
alongwith her counsel. The respondent Rahulkumar Govindbhai Patel is
absent. Rahulkumar appeared through his Ld. counsel Shri. S. K. Sharma.
Respondent deposited I.50,000/- and filed transaction receipt of dated
15/06/2026.
2. As per contention of the applicant there is huge arrears nearly
about I.5,00,000/-. The Respondent’s counsel submitted that, they will
pay I.50,000/- on next date.
3. On perusal of record it reflects that, this court directed to the
respondent to pay half of the arrears amount, but failed. In such situation
it is not appropriate to issue distress warrant against the respondent till
next date. Considering facts and circumstances of the case, I am inclined
to pass following order
ORDER
1. The respondent is directed to pay I.1,00,000/- to the
applicant as arrears of maintenance, on next date without
fail, if fail necessary order shall be passed agianst him.
2. Parties to take note.
