ORDER
1. The present application is filed for return of vehicle i.e.
Tata Indica Motor Car bearing Chassic No. MAT611223APD34671,
seized by the Santacruz police Station in C.R. No. 359/2021 registered
u/sec.377, 376, 511, 323 of IPC.
2. The Investigating Officer has no objection to return the
vehicle.
3. The applicant claims that he is entitled to the custody of
the vehicle. He submits that the chargesheet is filed. Hence, further
custody of the vehicle is not require. He has produced copies of Bail
Order, Statements and other documents filed alongwith the chargesheet
etc. He prayed for release of the vehicle.
4. On perusal of the chargesheet, it appears that there are
serious allegations against the accused. The alleged incident took place
in the car of the accused. Taking into account the allegations, the
vehicle appears to have been seized for the purpose of collection of
evidence. The accused may destroy the evidence if the vehicle is
released in his favour. Further the accused has not produced the RC of
the vehicle though he mentioned it in his list of documents. Thus, it is
difficult to ascertain as to who is its registered owner. He has not even
taken pains to mention the registration number in his application. In
such situation the vehicle cannot be release in his favour. As such
following order is passed:
ORDER
The application is rejected.
